What tax applies when you buy property in Dubai?

Residential property supplies in Dubai are generally VAT-exempt; commercial supplies attract VAT. Data context: Dubai South, median price per sq ft: AED 1,655.

Qualifying first residential supplies are zero-rated, while transfer fees remain payable separately. An individual’s qualifying real-estate investment income is excluded from UAE Corporate Tax. Check the property classification, any licensed activity and your overseas tax position before buying.

Which taxes and charges apply to your purchase?

VAT depends on the property’s legal use. Check whether you are buying residential or commercial property. Some mixed uses need closer review. Keep buying fees separate from tax on later income.

The VAT rules for real estate set out the key distinction. Supplies of homes are generally exempt. A first residential supply within three years of completion is zero-rated if it qualifies. Commercial property sold or let face the standard VAT rate.

You also pay fees to buy the property. DLD’s sale-registration service imposes sale charges separately. List the home’s VAT treatment separately from transfer charges in your buying budget.

Is a residential property purchase subject to VAT?

The rules differ for a first supply and later supplies of homes. A first supply must meet the rules. Ask the seller or adviser to confirm the legal class and completion date. Check whether an earlier sale or lease occurred.

A listing that says “new” does not prove this is a first supply. A recently built home may already have been supplied. Ask for the supply history. An unused-looking flat may not qualify for the same tax treatment as a developer’s first supply.

Purchase or activity What to check
First residential supply Residential classification, completion date and first-supply condition
Existing residential resale Whether the supply falls within the residential exemption
Commercial sale or lease Applicable VAT treatment and whether the quoted price includes it
Serviced or mixed-use property The precise classification and treatment of each relevant part
Professional services Their own invoices and VAT treatment, separate from the home
Later rental income Owner, activity and any relevant licensing requirement

The FTA’s Real Estate VAT Guide explains classifications and mixed-use situations. Ask a tax adviser to apply it to your contract. This matters for hotel apartments, serviced accommodation and mixed uses.

What applies to commercial property?

Commercial property supplies face standard-rate VAT. The rate was 5% on 15 October 2026. Ask whether the agreed price includes VAT. Get the right invoice and supporting sale documents.

Buying an office through a company does not make every VAT charge recoverable. Ask your adviser to check the buyer’s VAT status and planned use. Then check the rules for claiming VAT back. Show the cash due at completion separately from any later claim.

If the deal covers different property types or services, ask for a clear breakdown. Check what each payment buys and how tax applies. Resolve any dispute over the invoice before payment falls due. A short sales message is not enough.

Is the DLD transfer fee a property tax?

It is a separate registration charge, not the VAT treatment of the property supply. Use the buying-costs guide for the shared fee schedule instead of adding a second fee table here.

The registration fee resolution and DLD’s service page are the primary references. Check who pays each fee in your contract. Get a final statement showing each party’s share.

If a developer or seller covers a charge, ask how the contract records it. Check the completion account too. Find any terms or expiry. Record the promise separately from the official fee. A commercial fee waiver does not mean the authority abolished the charge.

Use the true-cost calculator to organise the purchase cash. Its planning inputs do not decide the property’s VAT status. Use your own agreed bank and adviser fees. Ask for advice on any unclear VAT charge.

Is an individual’s rental income subject to UAE Corporate Tax?

A natural person’s qualifying Real Estate Investment income is excluded from UAE Corporate Tax. The activity must meet that definition. It cannot be carried out, or need to be carried out, through a relevant licence.

Read the FTA’s guide for natural persons before applying that exclusion. Qualifying property investment differs from running a licensed business. Saying all Dubai rent is tax-free misses that distinction.

Ask your adviser who owns the property and how it earns income. A person’s qualifying investment and a company’s property business follow different rules. If you have both, keep clear contracts and accounts for each.

The FTA’s registration service explains what is left out of a natural person’s turnover. Ask the adviser to apply those rules to your case. Gross rent receipts alone do not decide whether you must register.

What changes if you let the home as a holiday home?

Check the activity and licence before using the personal investment exclusion. Holiday-home permits count as relevant licences in the natural-person guide. Ejari records a lease. It is separate from a licence to run a business.

Ask who runs the holiday home and which permits it needs. Then check how your contract splits income and costs. Give the tax adviser the management contract and ownership documents. Calling the arrangement passive income does not decide its tax treatment.

Use the same activity in your cash plan. A long-term home lease and a licensed short-stay business can have different costs and duties. Check again before applying one activity’s tax treatment to the other.

Could tax also apply outside the UAE?

Check the rules where you are tax resident. Other countries’ rules may also apply. Dubai’s tax treatment does not decide your tax or filing duties abroad when you rent or sell.

Start with the UK buyer guide or India buyer guide. Then get advice based on your actual residence and ownership structure. Avoid treating nationality as a complete tax review.

Keep purchase documents, rental statements, invoices and sale records. Ask which records and proof of exchange rates your tax country needs. Decide before letting or selling. You can then save the right documents as each deal happens.

What should you ask before signing?

Send your adviser a short list tied to the planned transaction:

  1. What is the property’s legal use and VAT classification?
  2. Is this a first supply, and what evidence establishes that?
  3. Is VAT included in the price or payable in addition?
  4. Which service invoices have their own VAT treatment?
  5. Which transfer charges must each party pay?
  6. Who will own and operate the property after completion?
  7. Does the planned letting activity require a licence?
  8. What overseas reporting applies to this owner?

Use the answers for two budgets: itemised costs at completion and annual costs to own. Link each amount to its invoice or contract. Use the official schedule for official fees. Keep sale fees and VAT separate from tax on later income.

What if the tax invoice differs from the quotation?

Ask the issuer to explain the difference before payment. Compare the property, service, price basis and VAT treatment with the signed contract. Find whether the quote omitted a separate service or whether the parties disagree about the supply itself.

Send the contract, quote and invoice together to your adviser. Request a corrected invoice or written explanation where needed, then update the completion budget. Keep the final records with your purchase file. Use the amount actually charged for later tax filings, instead of estimates or marketing promises.

Questions people ask

These answers connect the guide’s main questions with the rules and property data discussed above.

What do I pay on top of a resale apartment’s price?

Budget transfer and registration charges, your agreed professional charges and any financing costs separately from the property’s VAT treatment. Use the buying-costs guide for the shared fee schedule, then get itemised quotes. A VAT-exempt residential sale does not make the transaction free of other charges.

Does a promised DLD fee waiver mean there is no transfer fee?

No, find who has agreed to cover the charge and the conditions of that promise. Keep the offer and signed terms, and get advice if the promised contribution is withdrawn. A commercial incentive and the authority’s registration charge are different things.

Are the seller’s costs zero if the buyer pays the transfer and agency charges?

Not necessarily. Ask for the seller’s own completion statement, including any financing discharge, agreed service charges and professional costs. Check the seller’s tax status separately. Are they an individual with qualifying investment income, or selling through a taxable business?

Who pays the DLD transfer fee on a resale?

Check the official schedule and your written purchase agreement. The DLD sale service lists buyer and seller portions; the fee resolution addresses an agreement to allocate payment differently. Confirm the agreed allocation before signing, and distinguish that charge from VAT on the property or services.
