How do you pursue a Dubai property escrow refund?
First find who received your payment and check the project’s official status. Data context: Dubai South, median price per sq ft: AED 1,655.
Gather the contract and receipts, then add account evidence. Distinguish booking disputes from contractual refund claims. Formally cancelled projects need separate consideration. Ask the relevant authority or your adviser to confirm the route before submitting a claim or accepting a settlement.

Which refund route fits your payment?
Start with the recipient, the signed documents and the project record. A deposit, token or instalment needs its own review. Money confirmed in a project escrow account may follow a different route. Identify the payment before choosing where to submit the claim.
A refund depends on your contract and the project’s status. A complaint about a violation may need a separate money claim. Confirm the right route before filing.
Use this sequence:
- Find the original bank or card payment record.
- Find the recipient and purchase reference on the receipt.
- Read the booking terms, sale contract and any refund promise.
- Check the registered project status with DLD.
- Ask for a matched account and written response to your request.
- Have the appropriate complaint, settlement or claim route confirmed.
The table below helps you prepare that enquiry. It does not decide the legal outcome of your case.
| Your situation | Evidence to establish | Next route to check |
|---|---|---|
| Booking or EOI dispute | Recipient, terms, refund promise and payment | Written request and advice on the disputed agreement |
| Money sent as a project instalment | Project, escrow account and credited purchase statement | Accounting enquiry and the contract’s dispute route |
| Possible real estate violation | Specific conduct and supporting documents | DLD complaint scope |
| Contractual cancellation or money claim | Agreement, alleged breach, request and response | Competent judicial or agreed dispute route |
| Final RERA cancellation | Official decision and relevant project record | DLD/RERA confirmation of the applicable tribunal process |

Keep a separate record for each payment. Keep booking amounts and instalments separate if you paid different recipients. Explain each amount instead of giving only a total. Show your adviser what each payment was meant to cover.
How do you trace money said to be in escrow?
Dubai’s escrow law provides a project-specific account for off-plan development payments. Under Article 12, depositors or their representatives may access their own accounting records and request copies.
Ask the developer and relevant account trustee to trace the payment credited to your purchase. Give them the project reference and unit. Add the buyer’s name and transfer date. Include the receipt. Ask for a statement matching what you sent to what your account received.
Use this worksheet to prepare the request:
| Payment field | Record to keep |
|---|---|
| Original funds | Bank debit or card record |
| Recipient | Beneficiary shown by the payment record |
| Instruction | Invoice or payment message you followed |
| Purchase reference | Project, unit and buyer details |
| Credit | Receipt or purchase-account entry |
| Difference | Missing amount or inconsistent reference |
| Follow-up | Dated request and written response |

If the recipient differs from the claimed project account, ask for an explanation and supporting records. Do not alter the original payment evidence. Show both the instruction and the actual transfer record to the adviser handling your case.
Escrow accounting is not the same as permission to withdraw money. Tracing the funds helps find the claim. You still need a contract term or official basis for the refund. Ask the relevant parties which decision or contract authorises the payment back to you.
How do you check the project and your registration?
Use DLD’s project status enquiry with the registered project details. Save the response with the date of your check. If the marketing name differs from the registered project, ask why.
If someone says the project has been cancelled, ask for the official decision reference. Distinguish a buyer’s cancellation request from a final RERA project cancellation. Your booking may be cancelled while the project remains active. A booking message does not prove the project’s official status.
Check your initial-sale registration separately. DLD’s initial-sale service describes the developer’s registration submission. Ask for the issued certificate or DLD’s response about your record. The Oqood guide explains how to find that document.
If you have no certificate, tell the adviser what you hold. List booking terms and any signed contract. Add receipts or correspondence. Ask DLD to check the record. A missing copy does not prove a specific right to a refund.
What does a final project cancellation change?
Article 11, as amended in 2020, requires refunds when RERA issues a final reasoned cancellation decision. The developer must refund buyer payments through the escrow-law procedures. Confirm the decision and process for your project before treating that rule as the route for your own payment.
Decree No. 33 of 2020 addresses unfinished and cancelled projects. It gives the tribunal powers over liquidation and refund orders. Its stated scope excludes projects inside DIFC. Ask DLD/RERA or a qualified adviser which forum handles the project. Get the filing steps for that project.
Prepare the cancellation reference, ownership or initial-registration evidence, contract and matched payments. Ask which documents are missing and how to submit them. Ask whether a relevant case or order already exists. Check how your claim connects to it.
If you receive an order, keep the complete document. Ask the adviser to explain the amount, terms and any enforcement action needed. A message announcing a refund is not enough. Read what has actually been decided.
Is the DLD violation complaint a refund application?
No. DLD’s complaint terms exclude contractual disputes, revocation, refunds and compensation. The service handles real estate violations and negative practices within its published scope. Its terms also exclude disputes or complaints about contracts concluded more than six months earlier. Check whether that applies before submitting.
Describe a suspected violation precisely and attach the supporting record. Keep its complaint reference and response. Ask which issue the service is reviewing. Do not assume it has accepted every part of your money claim.
For a refund under your contract, check which court or agreed dispute route handles it. Give the adviser your contract, including any dispute-resolution clause. Ask where to bring the claim. Check whether a case already under way affects it. A violation report and a claim for money may require different actions.
If your question concerns a late handover, use the project-delay guide. Check whether that delay breaches your contract. This page helps you find the payment and route; it does not calculate damages or an exit percentage.
How do you make a clear written refund request?
Write to the person or company you believe owes the refund. Include the purchase reference and exact payment records. State the refund condition or contract term you rely on. Explain what you believe happened. Say what you want done.
Attach a short payment list. Explain what each screenshot proves if you include screenshots. Link each row to its receipt and bank record. Share private identifying details only through the secure channel for your case. Do not post your documents publicly to get a response.
For a payment described as refundable, include the written promise and all terms attached to it. Ask the recipient to explain any disputed condition in writing. If you never signed a sale contract, include the booking or EOI document you did accept.
Keep your request, delivery record and reply. If the recipient changes its position, preserve both responses. Give the adviser the full sequence. They need to review the dispute using the documents you actually received.
What should you check before accepting a settlement?
Read the proposed payment amount, date, payer and terms together. Find which payment or claim it settles. Ask what happens to the unit and booking. Check how registration changes. Ask what you must sign or surrender.
Have any release or waiver reviewed before accepting it. Clarify whether it takes effect on signature or after payment. Ask what happens if the promised amount is not paid and whether the document affects another unresolved claim.
Check with your bank how you will receive repayment. This matters especially if the money came from abroad. Keep the written contract and match the received amount to its terms. Keep your file open until you know what happened. A payment announcement alone is not enough.
If the settlement changes registration, get the official output confirming the action. Keep it with the contract and payment evidence. For instalment-account or transfer questions, consult the payment-plan checklist separately.
What should you take to your first advice appointment?
Bring a short timeline and the original documents. Include the contract and amendments, payment schedule, bank records, credited receipts, registration output, official project status, refund request and replies. List any missing documents clearly. Ask the adviser how to get them.
Write down your immediate question. Do you need to trace a recipient or confirm cancellation? Are you asking for accounts? Do you need help choosing a forum or reviewing a settlement? Ask what to do next and which records you need. Get the proposed steps and quoted costs in writing. Keep that instruction with the case record.
If you are considering another purchase, budget it independently using the buying-costs guide and calculator. Do not count an unresolved refund as cash you can use. Wait until you receive it.
Before you rely on this
Your payment recipient, contract, official project status and forum determine the next step. Confirm them before filing or signing a release. This guide does not promise a refund date, court outcome or direct withdrawal from escrow.

Questions people ask
These answers connect the guide’s main questions with the rules and property data discussed above.
How do I check whether RERA has cancelled my project?
Use DLD’s project status enquiry with the registered project references. Ask DLD or RERA to confirm the cancellation decision and applicable claim route. An agent’s message or a quiet construction site is not the final cancellation decision.
Can I recover a booking payment if I never signed the SPA?
Have the booking terms, payment evidence and correspondence assessed. The absence of a signed SPA alone does not prove the refund amount or deadline. Find the recipient and any agreed refund condition before making the request.
A token was described as fully refundable. What evidence should I use?
Keep the written promise, payment receipt and conditions attached to that promise. Send a dated refund request that identifies the amount, recipient and condition you say was met. Ask an adviser to check a disputed refusal.
Is an EOI refundable if I never sign a sale agreement?
Check the EOI’s actual terms and payment record. Ask the recipient to state its refund position in writing. Do not assume that the label EOI makes every payment refundable on the same conditions.
My cancellation request is unanswered. Is a DLD complaint enough?
DLD’s violation-complaint service excludes contractual cancellation, refund and compensation claims. Use it only for an issue within its published scope. For the refund claim, check the appropriate judicial or agreed dispute route.
